These Terms of Service govern your use of the winterROCs website at winterrocs.com and your participation in winterROCs events. By using this site or purchasing tickets to a winterROCs event, you agree to these terms.

winterROCs is a fine art fair and festival based in Rochester, New York. You can reach us at hello@winterrocs.com.
Using This Site
This site is provided for informational purposes and to facilitate artist applications, event registration, and newsletter signups.
You agree not to use this site to:
Submit false or misleading information
Attempt to gain unauthorized access to any part of the site or its systems
Transmit spam, malware, or any harmful code
Scrape or reproduce site content without permission
We reserve the right to restrict access to the site for anyone who violates these terms.
Intellectual Property
All content on this site — including the winterROCs name, logo, written copy, and images — is owned by or licensed to winterROCs. You may not reproduce, distribute, or use any of it without our written permission.
Artists who apply to or exhibit at winterROCs retain full ownership of their work and grant winterROCs a limited, non-exclusive license to photograph that work and use those photographs for promotional purposes, as described in the Event Policies.
Artist Applications
Submitting an artist application constitutes agreement to the Event Policies, which are incorporated into these terms by reference. The application fee of $20 is non-refundable. Acceptance is not guaranteed. All jury decisions are final.
Tickets and Purchases
Tickets purchased through this site are for the specific event and date listed at the time of purchase. All ticket sales are final. Refunds are not available except in the circumstances described below.
If winterROCs cancels the event: Ticket holders will receive a full refund of the ticket price. Processing fees charged by the payment provider are non-refundable.
If winterROCs postpones the event: Ticket holders will be offered the choice of transferring their ticket to the new date or receiving a full refund of the ticket price.
If you cannot attend: Tickets are transferable — you may give or sell your ticket to another person. Contact hello@winterrocs.com to transfer a ticket. Refunds are not available for personal schedule conflicts or changes.
Tickets are not valid for resale above face value.
Event Attendance
By purchasing a ticket and attending a winterROCs event, you agree to the following:
You grant winterROCs permission to photograph and record the event, and acknowledge that you may appear in photographs, video, or other media produced at the event. These may be used for promotional purposes.
You agree to conduct yourself in a manner appropriate for a public event and to follow any instructions given by winterROCs staff or venue personnel. winterROCs reserves the right to remove any attendee from the event without refund for disruptive or inappropriate behavior.
You attend at your own risk. winterROCs is not responsible for personal injury, loss, or damage to personal property during the event.
Limitation of Liability
To the fullest extent permitted by law, winterROCs is not liable for any indirect, incidental, or consequential damages arising from your use of this site or attendance at a winterROCs event. Our total liability to you for any claim arising from these terms or a winterROCs event shall not exceed the amount you paid to us in connection with that claim.
Third Party Services
This site uses third-party services including Squarespace for hosting and payment processing. Your use of those services is subject to their own terms and privacy policies. winterROCs is not responsible for the practices of any third-party service.
Changes to These Terms
We may update these terms from time to time. The date at the top of this page reflects the most recent update. Continued use of the site after an update constitutes acceptance of the revised terms. For significant changes, we will make a reasonable effort to notify users via email or a notice on the site.
Governing Law
These terms are governed by the laws of the State of New York. Any disputes arising from these terms or a winterROCs event shall be resolved in the courts of Monroe County, New York.
